A nest clearance survey is a mandatory inspection to confirm no active migratory bird nests are present before tree removal or vegetation clearing between April 1 and August 31. Required under the Migratory Birds Convention Act, it applies to homeowners, contractors, and tree removal companies alike. The clearance letter is valid for 48 hours and must be timed to when the work begins.

Under the federal Migratory Birds Convention Act and the Migratory Birds Regulations, 2022, it is illegal to disturb, destroy, or remove a nest containing a live migratory bird or viable egg. Ontario's Fish and Wildlife Conservation Act and the Endangered Species Act, 2007 provide additional protections.

What a Nest Clearance Survey Includes
Visual Inspection of All Vegetation
Every tree, shrub, and structure proposed for removal or disturbance is individually inspected for active nests, eggs, and nesting behaviour.
Cavity & Raptor Assessment
Cavities are monitored for bird activity. Special attention to early-nesting raptors (hawks, owls) and cavity nesters like the Pileated Woodpecker, a Schedule 1 species with year-round nest protection.
Schedule 1 Species Screening
We identify nests of the 18 species protected year-round under the MBR 2022, including Pileated Woodpecker (36-month protection) and Great Blue Heron (24-month protection).
Clearance Letter
A professional clearance letter documenting findings, valid for 48 hours from the time of survey. Issued by ISA Certified Arborists, independent of the removal contractor. The standard accepted by municipalities and conservation authorities across the GTA.

What it costs
Surveys are priced per site visit. The main factors are:
- Number of trees and site size. A single-tree residential removal is a different scope than clearing a multi-acre development site. Large commercial projects with dozens of trees are quoted accordingly.
- Schedule 1 species risk. Sites near known Pileated Woodpecker or Great Blue Heron habitat may require additional documentation before work can proceed.
- Timing relative to your crew. Early-morning surveys to match a removal crew's start time, or same-day requests, may carry a premium.
- Municipality format requirements vary. Some accept a single-page clearance letter; others specify report formats or digital submission through their permit portal.

When you don't need one
All tree work is scheduled for September through March, outside the April 1 to August 31 protected window (with the exception of Schedule 1 species, whose nests are protected year-round).
The scope is light pruning only, with no removal of branches or vegetation from areas where nests are typically located.
The work is entirely structural, with no tree or shrub disturbance, such as fencing, grading, or paving away from the drip line.
A city-issued emergency hazard order documents an immediate public safety risk requiring same-day intervention.

What does the survey involve?

Particular attention is paid to early-nesting species like raptors and Schedule 1 species such as Pileated Woodpecker and Great Blue Heron, whose nests are protected year-round.
What are Schedule 1 species?
Under the Migratory Birds Regulations, 2022, 18 species have year-round nest protection, even when the nest is unoccupied. In the GTA, the most commonly encountered are the Pileated Woodpecker (36-month wait to remove an abandoned nest) and Great Blue Heron (24-month wait). If a Schedule 1 nest is found, a notification must be submitted through the federal Abandoned Nest Registry before it can be removed.
What happens if a nest is found?
If an active nest is found, work must stop in that area immediately. A buffer zone is established around the nest, and work cannot resume near it until the young have naturally fledged and left the nest. We'll document the findings and advise on how to proceed. In many cases, work can continue in other areas of the site while the nest is active.
Can I do tree work outside of nesting season without a survey?
Generally yes. Outside the April 1 to August 31 window, most tree work can proceed without a nest sweep. However, some species nest earlier or later than typical dates, and nests of Schedule 1 species are protected year-round. If you're working in late March or early September, a precautionary survey is recommended.
What are the penalties for disturbing a nest?
Under the Migratory Birds Convention Act, individuals face fines up to $1,000,000 and/or up to 3 years imprisonment. Corporations face fines up to $1,000,000. Ontario's Fish and Wildlife Conservation Act carries additional penalties. Beyond legal consequences, violations can result in Stop Work Orders and significant project delays.
