Tree Bylaws in Burlington
Burlington's Private Tree By-law 40-2022 protects all trees with a trunk diameter of 20 cm or more on private property within the Urban Planning Area, excluding Halton woodland.
A permit costs a $54.00 processing fee plus a $351.50 issuance fee for one to three trees, plus HST. Replanting requirements are tiered by the size of the tree being removed, from two replacement trees for the smallest protected sizes up to four for significant trees. If you cannot replant on site, cash-in-lieu payments are $257.50 per replacement tree.
Properties within the Escarpment's Area of Development Control need a Niagara Escarpment Commission Development Permit when tree removal is part of a construction or development project. Ontario Regulation 828/90 exempts hazard and dead-tree removals.
