How Tree Removal Permits Work in Markham
Markham's Tree Preservation By-law 2023-164 replaced the earlier By-law 2008-96 and protects all private trees with a trunk diameter of 20 cm or more measured at 1.37 metres above ground. A permit is required before any protected tree can be removed or injured, regardless of health or condition.
Check if your tree is protected
Any private tree with a trunk diameter of 20 cm or more at 1.37 m above ground is protected. Dead, dying, and hazardous trees still require a permit, but replacement planting or cash-in-lieu does not apply when the permit classifies the tree in one of those categories.
Check the supporting documents
A Qualified Tree Expert report may be required as a condition of approval. High-risk expedited applications require a Tree Risk Assessment Report from a TRAQ-qualified arborist. We prepare the report that matches the city's request.
Submit your application
Applications go to the Tree Preservation Unit with a $20.50 non-refundable processing fee. Payment is due within 24 hours of the city's billing email, or the application may be cancelled or withdrawn. The 2026 tariff separately lists per-tree removal fees.
City review and decision
Markham reviews applications within 45 days of payment. Staff may request supporting documents or visit the site before communicating the decision.
Permit conditions and replanting
Replacement planting or cash-in-lieu may be required unless the tree is classified as dead, dying, or hazardous. Permit conditions use the Progressive Aggregate Caliper Method. A first conviction can carry a fine of $300 to $100,000.
