Tree Bylaws in Whitby
Whitby's By-law 4640-00 does not cover every private tree the way Toronto's or Mississauga's bylaws do. A permit is required only when a tree sits in one of several specific categories: a woodlot between 0.2 and 1.0 hectares, land zoned Environmental Protection, Conservation, Greenbelt, or Oak Ridges Moraine, a mature woodland or Environmentally Significant Area, a residential lot of 2.02 hectares or more, or a designated heritage district.
A standard residential lot outside those categories needs no municipal permit to remove an ordinary tree, at any trunk size.
Durham Region's Woodland By-law 30-2020 applies on top of Whitby's own triggers, adding a separate permit requirement for woodlands of 1 hectare or more anywhere in the Region.

Minimum Diameter
Zone-based permit: required for woodlots of 0.2 to 1.0 hectares, land zoned Environmental Protection, Conservation, Greenbelt, or Oak Ridges Moraine, mature woodlands and Environmentally Significant Areas, residential lots of 2.02 hectares or more, and heritage districts. No permit needed for an ordinary tree on a standard residential lot outside those categories.
Permit Fee
$6,092 flat fee per Tree Removal Permit (PAP-73, Fees and Charges By-law 7220-17, Schedule M, 2026)
Processing Time
Where a permit applies, the Town responds within 15 business days.
Penalty
Up to $10,000 on a first conviction and up to $20,000 on a subsequent conviction (By-law 4640-00, s.10(1))
