Understanding Whitby’s Tree Rules

Whitby doesn’t have a single city-wide diameter threshold the way Toronto or Mississauga does. Instead, By-law 4640-00 requires a permit only when a tree falls into one of several defined categories. Get the zoning and lot size right, and most Whitby homeowners on a standard lot need nothing at all. Get it wrong, and a routine removal can turn into a stop-work problem.

When a Permit Is Required

A Tree Removal Permit applies to a tree that falls into any of these categories:

  • A woodlot between 0.2 and 1.0 hectares
  • Land zoned Environmental Protection, Conservation, Greenbelt, or Oak Ridges Moraine
  • A mature woodland or an Environmentally Significant Area
  • A residential lot of 2.02 hectares or more
  • A designated heritage conservation district, including Werden’s Plan and Brooklin

A standard residential lot outside all five categories needs no municipal permit to remove an ordinary tree, regardless of trunk size.

Durham Region’s Overlay

Durham Region’s Woodland By-law 30-2020 applies on top of Whitby’s own triggers. It covers woodlands of 1 hectare or more anywhere in the Region, including Whitby, independently of whether the property also meets one of Whitby’s own five categories. A large treed lot can trigger the regional bylaw even if it falls outside Whitby’s own woodlot size band.

Construction and Development Applications

Site plan approval, subdivision applications, and building permits for additions or new construction can require a tree inventory and protection plan from the Town’s planning department, whether or not the property sits inside one of the bylaw’s protected categories. This runs alongside, not instead of, the tree bylaw’s own triggers.

How This Plays Out on a Real Project

Step 1: Confirm the Zoning and Lot Size

Before recommending a removal path, we check the property’s zoning against Whitby’s five trigger categories and its lot area against the 2.02 hectare threshold. Most standard suburban lots clear this check with no permit required.

Step 2: Permit Application, If Triggered

If the property falls into a protected category, we prepare the documentation Whitby’s reviewers expect, tailored to which trigger applies: a woodlot assessment, an Environmental Protection Area impact statement, or heritage district documentation.

Step 3: Durham Region Woodland Check

Independently of Whitby’s own categories, we check whether the treed area meets the Region’s 1 hectare woodland threshold. If it does, we prepare the separate documentation Durham Region’s forestry reviewers require.

Step 4: Town or Region Review

Whitby reviews applications tied to its own five trigger categories. Durham Region reviews woodland permit applications separately. A property can require both reviews at once if it meets triggers under each bylaw.
