Tree Bylaws in Milton
Milton has no private tree protection bylaw for individual trees on residential or commercial lots. If your project involves a single tree on a standard lot, no municipal permit is required to remove it.
Two other rules apply. Halton Region's Tree By-law 121-05 covers woodlots of 0.5 hectares or more with more than 500 trees per hectare over 12 cm DBH, regardless of which Halton municipality they sit in. Separately, the Town's development-application standards require any existing tree greater than 150 mm in calliper to be shown and protected on site plans submitted for building permits, site plan approval, or subdivision.
Milton tree permit rules
Minimum Diameter
No private tree bylaw for individual trees. Halton Region woodlots of 0.5 ha or more with qualifying tree density are regulated under By-law 121-05. Development site plans must show existing trees greater than 150 mm in calliper.
Permit Fee
No permit fee for private tree removal, since no permit is required. A Halton Region Special Council Permit applies to a qualifying woodlot (By-law 121-05, Schedule A). Confirm the fee with Halton Region.
Processing Time
No municipal permit for a private tree. Development tree inventories are reviewed with the site plan.
Penalty
None for a private tree outside a qualifying woodlot. In a woodlot, By-law 121-05 fines reach $10,000 or $1,000 per tree (first conviction) and $25,000 or $2,500 per tree after that, whichever is greater. Corporations: $50,000 or $5,000 per tree, then $100,000 or $10,000 per tree
