Milton has no private tree bylaw

Milton has no private tree protection bylaw for individual trees. If you’re removing a single tree from a standard residential or commercial lot, no municipal permit applies, regardless of species or size. This surprises a lot of new Milton homeowners coming from Mississauga, which regulates trees as small as 15 cm.

Two rules still apply in Milton: Halton Region’s woodlot bylaw, and the Town’s own development-application standards for anyone submitting a site plan, subdivision, or rezoning application.

The Two Regimes That Still Apply

Halton Region Tree By-law 121-05

This regional bylaw, in force since 2006, covers woodlots of 0.5 hectares or more with more than 500 trees per hectare over 12 cm DBH, anywhere in Halton including Milton. A cluster of mature trees on a large rural or estate lot can meet this threshold.

Development-Application Tree Inventories

Any existing tree greater than 150 mm (15 cm) in calliper on a property going through site plan approval, subdivision, or a building permit tied to a development application must be shown on the plans and protected during construction, per the Town’s Engineering and Parks Standards Manual.

What Requires Documentation

• Woodlot removal meeting Halton Region’s 0.5 ha / 500 trees-per-ha / 12 cm DBH thresholds
• Any existing tree over 150 mm calliper on a property with an active development application
• Trees on Town road allowance or parkland, which require Town approval before removal

What Doesn’t

• Removing an individual tree on a standard residential lot, at any diameter, outside a qualifying woodlot

Our process for a Milton property

Step 1: Confirm Which Regime Applies

A single-family removal in Milton needs nothing from us or the Town unless one of two situations applies: the tree sits within a Halton Region-qualifying woodlot, or the property is going through a development application where site plan standards require a tree inventory.

Step 2: Woodlot Documentation, If Applicable

For a qualifying woodlot removal, Halton Region’s process governs. We assess the treed area against the Region’s density thresholds and prepare the documentation the Region’s forestry contact requires.

Step 3: Development-Application Tree Inventory, If Applicable

For a site plan or subdivision project, we inventory every existing tree over 150 mm calliper, note which will be protected versus removed, and specify tree protection hoarding per the Town’s Engineering and Parks Standards Manual. This gets folded into the broader development submission reviewed by Development Services.

Step 4: Town or Region Review

There’s no standalone tree-permit review track in Milton. Woodlot documentation is reviewed by Halton Region. Development-application tree inventories are reviewed as part of the site plan process by the Town’s Development Services Department.

Replacement Requirements

Milton has no published replacement ratio for individual private trees, because there’s no bylaw requiring one. For development applications, Milton publishes no replacement ratio, and a landscape plan condition is set per application.
