How Tree Removal Permits Work in Burlington

Burlington's Private Tree By-law 40-2022 has a tiered fee and replanting system based on tree size. Properties near the Niagara Escarpment face a second layer of regulation. Understanding both sets of rules is important before starting any tree work.

Check if your tree is protected

Any tree with a trunk diameter of 20 cm or more at breast height on private property within the Urban Planning Area is protected. Trees 75 cm and larger are classified as 'significant trees' and face stricter review.

Check for Escarpment regulations

If your property is within the Niagara Escarpment plan area, you may need a Development Permit from the Niagara Escarpment Commission in addition to the city permit. We determine whether this applies during our site visit.

Get an arborist report

Burlington requires a report from an ISA Certified Arborist. The report documents species, size, health, structural condition, and removal justification. For significant trees (75 cm+), a more detailed assessment is expected.

Submit your application and fees

Applications go through Burlington's tree permit portal. The processing fee is $52.50 (paid at submission, non-refundable). The issuance fee of $341.50 for 1-3 trees (plus HST) is collected upon approval.

Replanting requirements

Burlington uses a tiered system: 2:1 for trees 20-35 cm, 3:1 for 36-74 cm, and 4:1 for trees 75 cm and larger. If you cannot replant on site, cash-in-lieu payments are $257.50 per replacement tree.

Tree Removal Permit FAQ: Burlington

Common questions about tree removal permits in Burlington

What is a 'significant tree' in Burlington?

Trees with a trunk diameter of 75 cm or more are classified as significant trees under By-law 40-2022. They face a 4:1 replanting ratio and additional scrutiny during the review process. Applications to remove significant trees are more likely to be denied unless the tree is dead or poses a clear safety risk.

Does the Burlington bylaw apply to my property?

The bylaw applies to private property within Burlington's Urban Planning Area, which covers most developed parts of the city. Properties within the Niagara Escarpment plan area are subject to additional provincial regulations. Rural properties outside the Urban Planning Area may have different requirements.

What are the replanting requirements in Burlington?

Burlington uses a tiered system based on the diameter of the tree being removed. Trees 20-35 cm require 2 replacements, 36-74 cm require 3 replacements, and trees 75 cm and larger require 4 replacements. If you cannot replant on your property, cash-in-lieu payments of $257.50 per tree are accepted.

How do Niagara Escarpment rules affect my tree removal in Burlington?

If your property falls within the Niagara Escarpment plan area, you may need a Development Permit from the Niagara Escarpment Commission on top of your city permit. The NEC rules can be more restrictive. We handle both applications simultaneously to avoid delays.

How much does a tree removal permit cost in Burlington?

The total fee for 1-3 trees is about $445 plus HST. That breaks down to a $52.50 processing fee (non-refundable, paid at submission) and a $341.50 issuance fee (paid upon approval). Dead or high-risk trees are exempt from fees but still need a permit.

Can I remove an invasive species without a permit in Burlington?

Invasive species listed by the city are exempt from the permit requirement. However, you should confirm the species is on the city's invasive list before removing it. Our arborist can identify the species during a site visit and confirm whether the exemption applies.
