Understanding Oakville’s Tree Protection
Oakville’s Private Tree Protection By-law 2017-038 protects all trees on private property with a diameter of 15 cm or more at breast height. This is one of the lower thresholds in the GTA, meaning even relatively young trees may require a permit before removal.
The mature neighbourhoods south of the QEW feature some of the largest and oldest trees in the region, and the town takes their preservation seriously.
The Private Tree Protection By-law
Oakville’s By-law 2017-038 applies to every tree on private property within the town’s boundaries that has a diameter of 15 cm or more at breast height. There are no species exclusions and no exemption based on property size.
What Requires a Permit
- Removing any tree 15 cm+ DBH on private property
- Injuring a tree in a way that is likely to cause its decline or death
- Any construction or grading activity within a tree’s critical root zone
Exemptions
The bylaw does provide a few exemptions:
- Dead trees (confirmed by the town or a certified arborist)
- High-risk trees that pose an immediate danger
- Ash trees (due to the ongoing emerald ash borer crisis)
- Buckthorn (an invasive species the town wants removed)
For dead, high-risk, ash, and buckthorn trees, no application fee is charged, though you still need to apply.
Heritage Tree Protections
Oakville maintains one of the strongest heritage tree programs in Ontario. The town identifies and designates trees of exceptional size, age, species rarity, or historical significance. Heritage Trees receive additional protections beyond the standard bylaw, and permit applications for their removal face a higher bar for approval.
The town maintains records of designated Heritage Trees, and properties with these specimens may have conditions attached to them that require ongoing care and maintenance. If you are buying a property in Oakville, it is worth checking whether any trees on the lot carry a heritage designation.
How to Apply for a Tree Removal Permit
Step 1: Determine Your Situation
Check whether your tree is 15 cm or more in diameter at breast height. If yes, you need a permit. If the tree is dead, ash, or buckthorn, the process is simpler and there is no fee. For all other trees, you need to go through the full application process.
Step 2: Hire an ISA Certified Arborist
Oakville requires an arborist report for permit applications involving healthy or declining (but not dead) trees. The report should cover:
- Tree species, size, and location
- Health and structural condition assessment
- The reason for the proposed removal
- Impact on neighbouring trees
- Recommended replanting
For heritage trees, the report will receive closer scrutiny, and the arborist should address why the tree cannot be preserved through alternative measures such as pruning, cabling, or construction redesign.
Step 3: Submit Your Application
Applications go to the Town of Oakville’s Forestry section. You will need:
- A completed Private Tree Removal Permit application
- An arborist report (where required)
- A property survey or site plan showing tree locations
- The application fee ($65 for first tree 15-24cm, $425 for additional/larger trees; waived for dead/ash/buckthorn)
- Photos of the tree
Step 4: Town Review
Oakville’s forestry staff review the application and an inspector typically contacts the applicant within 5 business days. Heritage tree applications or applications near environmentally sensitive areas may take longer. The town will approve, deny, or approve with conditions.
Fees
Oakville’s fee structure depends on tree size and application type:
- First tree (15-24 cm): $65
- Each additional tree or larger tree: $425
- Development applications: $900
- Dead, ash, or buckthorn trees: no fee

Replanting Requirements
Oakville requires replacement tree planting at a ratio of 1 tree per 10 cm of DBH removed. So a tree with a 30 cm diameter would require 3 replacement trees. A $300 refundable security deposit is required for each replacement tree, returned once the trees are confirmed established.
The town encourages native species for replacements and may specify particular species or sizes. If on-site replanting is not feasible, cash-in-lieu payments apply. Oakville uses these funds for its public tree planting program.
Penalties
Unauthorized tree removal in Oakville carries penalties ranging from $300 to $10,000 or more. Homeowners who remove protected trees without a permit can face enforcement action. The town investigates complaints and monitors development sites for compliance.
Creek Corridors and Lakefront Properties
Properties near Bronte Creek, Sixteen Mile Creek, and the Lake Ontario shoreline may face additional environmental protections beyond the tree bylaw. These areas often fall under Conservation Halton’s jurisdiction, which can require separate permits or environmental impact assessments for tree removal and construction activities.

Development-Related Tree Permits
For construction projects, the tree permit process is integrated with site plan approval. Builders must provide:
