Tree Bylaws in Whitchurch-Stouffville
Whitchurch-Stouffville's Private Tree Preservation and Protection By-law 2023-060-RE applies only within the town's Secondary Plan settlement areas: Stouffville, Gormley, Vandorf-Preston Lake, Ballantrae-Musselman Lake, and the Hamlet of Bloomington. Outside those boundaries, the bylaw's Mature Tree permit requirements don't apply.
Within those settlement areas, a Mature Tree is defined by its trunk diameter (10 cm (Private Tree below the Mature Tree class, identified for protection on Landscape Plans with a site plan, subdivision or consent application in a Secondary Plan settlement area); 30 cm (Mature Tree in a Secondary Plan settlement area, regulated through a site plan, subdivision or consent application)), and removing or injuring one is authorized through the Planning Act process rather than a standalone permit, through a Site Plan, Subdivision, or Consent application. Replacement runs on a two-tier ratio: 3 trees for every Mature Tree removed up to 49 cm, rising to 5 trees at 50 cm and larger, with cash in lieu, at a tree value the Town sets, when on-site planting isn't feasible. Heritage Trees designated under the Ontario Heritage Act cannot be removed under any circumstances.
The bylaw sets the hoarding radius at 2.5 metres for the first 30 cm DSH, plus 0.5 metres per further 10 cm.

Penalty
First conviction: $500 to $50,000. Second or subsequent conviction for the same offence: $2,000 to $100,000. Continuing offence: $2,000 to $10,000 for each day. Each tree removed is a separate offence (By-law 2023-060-RE, s.7)
