Tree Bylaws in Whitchurch-Stouffville

Whitchurch-Stouffville's Private Tree Preservation and Protection By-law 2023-060-RE applies only within the town's Secondary Plan settlement areas: Stouffville, Gormley, Vandorf-Preston Lake, Ballantrae-Musselman Lake, and the Hamlet of Bloomington. Outside those boundaries, the bylaw's Mature Tree permit requirements don't apply.

Within those settlement areas, a Mature Tree is defined as 30 cm or larger in diameter at standard height, and removing or injuring one is authorized through the Planning Act process rather than a standalone permit, meaning it typically comes up during a Site Plan, Subdivision, or Consent application. Replacement runs on a two-tier ratio: 3 trees for every Mature Tree removed between 30 and 49 cm, rising to 5 trees at 50 cm and larger, with cash-in-lieu available under the Town's Fees and Charges By-law when on-site planting isn't feasible. Heritage Trees designated under the Ontario Heritage Act cannot be removed under any circumstances.
