Tree Bylaws in Newmarket

Newmarket protects private trees 20 cm or larger in diameter at breast height under its Private Tree Protection By-law 2022-10, and adds a separate tier for Significant and Heritage Trees that cannot be removed under any permit type regardless of size.

The Town's application fee scales with the number of trees in a single submission, from $100 for one tree up to $5,000 for eleven or more, plus a per-tree review fee. Replacement obligations differ by removal type: a flat one-for-one count for ordinary removals, and an Aggregate Inch Method for construction-related removals that ties total replacement caliper to total removed diameter.
