Tree Bylaws in Newmarket
Newmarket protects private trees 20 cm or larger in diameter at breast height under its Private Tree Protection By-law 2022-10, and adds a Heritage Tree category. No one may injure or destroy a Heritage Tree without approval under the Ontario Heritage Act and a Private Tree Permit.
The Town's application fee scales with the number of trees in a single submission, plus a per-tree review fee of $105.16 before HST. Confirm with Newmarket for the application fee tiers. Replacement obligations differ by removal type: a flat one-for-one count for ordinary removals, and an Aggregate Inch Method for construction-related removals that ties total replacement caliper to total removed diameter.

Penalty
By-law 2022-10 sets no court fine of its own. Under AMPS By-law 2024-16 the set penalty for injuring or destroying a tree without a permit is $1,000 for a first offence, $1,500 for a second and $2,250 for a third. A contravention is also an offence with a fine as provided by the Provincial Offences Act, and each tree is a separate offence
