How Tree Removal Permits Work in Hamilton
Hamilton does not have a single tree bylaw. Instead, separate pre-amalgamation bylaws still apply depending on where your property is located. Ancaster, Dundas, and Stoney Creek each have their own rules. Flamborough, Glanbrook, and most of the former City of Hamilton have no private tree bylaw at all.

The rules depend on your property's location. Ancaster protects trees 45 cm and larger. Dundas protects trees from 15 cm. Stoney Creek covers woodlots in the Escarpment area. Flamborough, Glanbrook, and most of the former City of Hamilton (lower city, Mountain, east end) have no private tree bylaw. We determine this during our site visit.
Check for Escarpment and Conservation Authority rules
Properties within the Niagara Escarpment plan area or near regulated watercourses may need additional permits from the Niagara Escarpment Commission or Hamilton Conservation Authority, regardless of whether a municipal tree bylaw applies.
Get an arborist report
Where a bylaw applies, an arborist report documenting species, size, health, and removal justification is required. Even in areas without a private tree bylaw, a report may be needed for Escarpment or Conservation Authority applications. We prepare reports that satisfy all applicable authorities.
Submit the application
For municipal tree permits, contact MLETrees (MLEtrees@hamilton.ca or 905-546-2424 ext. 2782). Applications are paper-based. For development projects, Tree Preservation Plans go through the planning department with a $750 review fee.
Review and conditions
Processing times vary by area and application type. Replanting requirements are generally determined case by case. Escarpment and Conservation Authority applications follow their own timelines and may take longer.

Common questions about tree removal permits in Hamilton
Does Hamilton have a tree bylaw?
Hamilton has multiple tree bylaws inherited from pre-amalgamation municipalities. Ancaster, Dundas, and Stoney Creek each have their own rules. Flamborough, Glanbrook, and the former City of Hamilton (lower city, Mountain, most of the east end) do not have private tree bylaws. The city also has an Urban Woodland By-law that applies city-wide to woodlands 0.2 hectares or more.
How do I know which bylaw applies to my Hamilton property?
It depends on which former municipality your property falls in. We determine this during our site visit. As a general guide: if you are in Ancaster, trees 45 cm+ are protected. In Dundas, trees 15 cm+ are protected. In Stoney Creek, woodlot regulations apply in Escarpment areas. In most other parts of Hamilton, there is no private tree bylaw.
Is Hamilton getting a unified tree bylaw?
The city has discussed creating a single private tree bylaw to replace the patchwork system. As of early 2026, no unified bylaw has been adopted. We monitor this situation and will adjust our processes when any changes take effect.
Do Niagara Escarpment rules apply in Hamilton?
Yes. The Escarpment runs through Hamilton, and properties within the plan area are subject to provincial Escarpment regulations regardless of which former municipality they fall in. A Development Permit from the Niagara Escarpment Commission may be required for tree removal. This is separate from any municipal tree bylaw.
I live on the Mountain in Hamilton. Do I need a permit to remove a tree?
Most of the Mountain (former City of Hamilton) does not have a private tree bylaw, so you generally do not need a municipal permit for trees on your private property. However, if your property is within a designated urban woodland or the Escarpment plan area, those regulations still apply. Boulevard and city-owned trees are always protected.
What about heritage trees in Ancaster?
Ancaster has heritage tree designations that provide additional protection for exceptional specimens. Heritage trees face stricter review and removal applications are more likely to be denied.
